Hyperion — Website and Closed-Pilot Terms

25 October 2026

1. Operator and contact

The Hyperion website, waitlist and closed-pilot cooperation are operated by Natalia Lewczuk under the Hyperion Performance brand (the “Operator”). Correspondence address: ul. Dubois 4a/4, 15-349 Białystok, Poland. For service questions, complaints and personal data matters, email contact@hyperion-performance.com. These Terms and the Privacy Notice remain freely available on Hyperion's public pages. A particular pilot or research study also requires its own participation arrangements and, where applicable, participant information, consents and required approvals; these Terms do not replace them.

2. Service and charges

Hyperion is in research and development (R&D), with closed pilots, calibration and scientific validation. There is no open, free Early Access programme for everyone. Coaches, clubs and other partners may enquire about a pilot; individuals may join the waitlist. Neither action creates a system account, grants measurement access, guarantees admission or enrols anyone in research. The public interface preview uses example data, performs no real measurements and does not provide a personal diagnostic result. Access to the actual system is granted individually under the agreed pilot scope, duration, eligibility, consents and applicable approvals. Its financial terms, if any, are set out separately before participation; these Terms are not an offer of universally free pilot access. A participant account may provide the features enabled for that pilot: a profile, the short Core Test, history, recovery plans and — after a qualified measurement — the informational Biology Readiness Index (0–100) and fatigue profile. The test may include an autonomic signal from a supported device or phone camera, attention and reaction tasks, tapping, picture description and self-assessment. Availability depends on device compatibility, required consents, measurement quality and the agreed access type. Passive data, for example from a phone or wearable, may provide additional context but does not currently change the active score or automatically trigger a test. The system has not yet completed calibration and validation; technical errors may occur, and results and recommendations may change during development. Participant measurements and feedback help develop the system within the scope of given consents and applicable pilot or research documentation. There is no fixed commercial launch date. Future package descriptions are indicative, not plans currently available to purchase; prices and commercial terms will be announced separately. A waitlist signup or enquiry is free of charge and starts no subscription or automatic payment. Previously acquired rights remain governed by their original terms.

3. Waitlist and pre-launch benefit

The current waitlist offer grants a 50% discount for the first 12 months of a paid individual subscription after launch. The 12-month period starts upon activation of the paid subscription, not on the signup date. Signup does not create an account, activate a subscription, grant system access or enrol anyone in a pilot or study. Development and availability updates require the separate mailing consent shown in the form; it can be withdrawn at any time. An enquiry from a coach, club or other organisation does not by itself subscribe its sender to mailing or grant the individual waitlist benefit. We record the terms applicable to a signup. Availability and redemption instructions will be communicated by email; no public code or current purchase is required. Any future purchase requires a separate decision after its price and terms are presented. Withdrawing mailing consent does not cancel an already granted benefit; contact us if you need to confirm your entitlement. This is not a new lifetime-discount offer. Rights already acquired or individually confirmed under earlier offers, including any earlier discount terms, are not replaced, shortened or revoked by this change.

4. Account, age and consents

Accounts are provided to admitted participants under the arrangements for a specific closed pilot; there is no public self-enrolment under these Terms. Where an account is provided, registration uses an email address and password, with email verification by code. The scope and duration of access follow the pilot arrangements rather than an automatically created, indefinite free account. Account users must be at least 13, and a pilot or study may impose stricter age and eligibility criteria. If participants aged 13–17 are admitted, they take part with the knowledge and required consent of a parent or legal guardian; the guardian should read the relevant documents with the young person, take part in completing the profile and consenting before measurement, and respect the young person's objection. Do not provide false details or use another person's account. Acceptance of these Terms, a waitlist signup or a pilot enquiry does not replace the separate explicit consent to processing health data required before measurement, research-participation consent or other applicable approvals. Optional data sources and trainer access require separate choices.

5. Technical requirements and safety

You need a compatible phone with a supported iOS or Android version and internet access for sign-in and synchronization. Specific activities need access to a camera, microphone or compatible device. A test may not return a score if signal quality is insufficient. Phone-camera PPG measurements are under development; we do not claim that their accuracy or results are equivalent to those of Elite HRV or validated reference measurement methods. Hyperion is intended to support wellness, recovery and wellbeing, not to diagnose or treat diseases. Recovery protocols and plans are informational recommendations, not treatment instructions or a replacement for medical advice. The proposed methods draw on scientific literature and research conducted by third parties; this does not establish the effectiveness of a particular recommendation for every user or constitute clinical validation of the Hyperion system. Outputs and recommendations may be incomplete. We do not guarantee specific effects or improvements in recovery, wellbeing or sporting performance. You decide whether to follow a recommendation and are responsible for your own decisions, truthful answers to safety questions and following the stated precautions. Do not use a method if it is contraindicated for you or conflicts with advice from a healthcare professional. Do not change or discontinue prescribed treatment on the basis of the system's recommendations. These provisions do not exclude or limit the Operator's liability where it cannot lawfully be excluded or limited, or your mandatory statutory rights. If you experience pain, dizziness, shortness of breath or any other concerning symptoms, stop the test or recovery method immediately and consult a doctor, physiotherapist or other appropriately qualified healthcare professional. In an emergency, seek medical assistance without delay; do not wait for an email reply. You may also access a free consultation with a qualified physiotherapist who holds the right to practise, by contacting the system's email address given in section 1: contact@hyperion-performance.com. This consultation is not an emergency service and does not replace urgent medical assistance.

6. Club and trainer

An athlete's account remains their own. The athlete initiates a club link, which the club accepts. Separately, the athlete may grant a named trainer read-only access to specified detailed assessments via an email or QR invitation. Access can be revoked in the app; club membership alone does not give a trainer access to all raw measurements, recordings or device data. Club account terms and a club's responsibility for data it receives may be set out separately.

7. Leaving, changes and complaints

You may stop a test at any time, withdraw consent to future measurements and request deletion of account data through the data-rights feature or the email in section 1. Submitting a request does not itself delete data; after identity verification, the team reviews and carries it out under the Privacy Notice, and an incomplete erasure remains an open case. You may withdraw mailing consent separately without cancelling an already granted discount. The Operator may change developing features or end a pilot in accordance with its arrangements, participant information and applicable law, after giving advance notice of material changes. No new charge applies without your separate decision. Send complaints by email or post to the contacts in section 1; the Operator will reply without undue delay in a durable form. Consumers may withdraw from a distance contract within 14 days by sending a clear statement through these channels and may stop participation later too. Nothing in these Terms excludes mandatory statutory rights.

8. Final provisions

You may use the app for your own participation; rights in the brand, materials and software remain with their respective owners. Circumventing security or infringing others' rights is prohibited. The Operator may restrict access for misuse, giving a reason and an opportunity to clarify where possible. We will notify you before a material change to these Terms takes effect; it will not remove rights already acquired. Polish law applies without prejudice to mandatory consumer protections in the participant's country of residence.
